Summary:
The Law Clerk is responsible for independently completing a wide array of confidential legal and administrative duties for teams practicing various law specialties such as Employment, Advisory, and Contracts.
The Law Clerk will perform a triage service, monitor caseloads to ensure critical activities are completed within statutory or contractual time limitations, prepare and assemble documents and work with a variety of databases and systems to maintain information and produce analytical reports.
Major Responsibilities:
Provide confidential legal assistance to Employment and Advisory Legal Counsel and Paralegal – HR Specialty who are handling matters such as terminations, disciplines, grievances, labour relations and human rights claims by:
- Triaging incoming requests for service by identifying and reviewing pertinent information to prioritize, assign, or refer work
- Gathering information from a variety of internal and external sources to identify relevant data/cases and summarize the information to support decision making by Legal Counsel and/or Paralegal – HR Specialty
- Preparing or guiding the preparation of documents such as labour employment releases and voluntary exit agreements as per Legal Counsel’s or Paralegal – HR Specialty instructions
- Verifying labour and employment settlement information prior to execution to ensure monetary values are accurately recorded
- Assisting to arrange grievance meetings, human rights hearings and conferences
- Monitoring abeyance systems relating to hearing/appeal dates and venues
- Act as a point of contact to receive and process advisory matters such as Workplace Safety and Insurance Appeals Tribunal (WSIAT) correspondence relating to Notices of Appeal/requests for submissions and Powers of Attorney. This may include, but is not limited to reviewing preliminary information, drafting correspondence, identifying, implementing or guiding next course of action
Perform a variety of advanced database and system functions within Microsoft Access and other WSIB systems to:
- Enter, gather and summarize information for Legal Counsel/Paralegal to facilitate informed decision making related to matters such as volumes, financial settlements etc.
- Search and extract information to identify potential trends or exceptions for further review by management or Legal Counsel
- Prepare a variety of operational reports for Senior Management review and present information in specified professional formats
- Produce documents such as charts and web based forms to support the work of the various legal practice groups
- Provide support to a team of internal commercial lawyers from the initiation of a confidential procurement activity to contract finalization by:
- Interacting with internal departments such as Strategic Procurement to gather preliminary information about requests for services by the Legal Services Contracts group
- Analyzing information provided by Strategic Procurement/line of business to determine the scope and nature of the request and validity of the urgency
- Gathering any supplementary information from a variety of sources such as the request originator, proposals and budget approval documents, business cases, correspondence, etc. to assist in assigning work by taking into account factors such as capacity, specialized knowledge and prior experience with subject matter.
- Accurately preparing/amending a variety of confidential contracts and agreements such as Consulting Services Agreements, Funding Agreements/Grants, Goods and Services Agreements, Statement of Work, Extensions, Schedules/Appendix/Addendums for review.
- Manage electronic and physical records by:
- Opening and maintaining files to ensure complete and up to date information
- Assisting to manage the security of confidential executed contracts and other material in accordance with the directive and oversee any associated database
- Collaborating with Branch peers and other WSIB areas to ensure proper storage, retention and destruction of records as per established retention schedules
- Recommending enhancements to systems/processes to improve the efficiency by which information is stored and retrieved.
- Perform other related duties as assigned or required such as:
- Participating in ad hoc committees at a divisional or inter-divisional level to provide input into the development of systems, work processes and procedures
- Signing as Commissioner of Oaths
- Taking general enquiry telephone calls to provide assistance and information to internal and external parties and route calls to appropriate staff member, department or agency
- Maintaining and updating job procedures manual and business continuance plan
- Assisting or backing up other positions within the Branch
- Providing training/cross-training to other staff
1) Education requirements:
Legal Clerk Designation or Paralegal Designation.
2) Experience:
Minimum three (3) years of experience in handling matters involving Employment Law and Personal Injury litigation.
